JUDGMENT ADOPTING re 50 Report and Recommendations; denying 33 Motion to Dismiss for Lack of Jurisdiction; granting in part and denying in part 33 Motion for Summary Judgment. IT IS ORDERED that the United States' MTD and MSJ 33 is D ENIED as to James's FTCA claim. IT IS ALSO ORDERED that the United States' MSJ 33 is DENIED IN PART as to LaCroix and Carvajal, on James's Bivens claim for deliberate indifference to his complaints of sexual harassment.
