JUDGMENT ADOPTING 10 Report and Recommendations, 1 Complaint,, filed by Kennith W Montgomery as to the plaintiff's claims for monetary damages resulting from his alleged illegal arrest, trial and conviction, the court adopts the recommen dation in its entirety, and dismisses, with prejudice, the plaintiff's claim for monetary damages as legally frivolous and that the plaintiff's petition for habeas corpus be dismissed, with prejudice, for failure to exhaust his state court remedies, however, that portion of the Report and Recommendation is AMENDED to reflect that the plaintiff's habeas corpus claims are dismissed, without prejudice.
