JUDGMENT in accordance with the 12 Memorandum Ruling, the court will adopt the 9 Report and Recommendations. IT IS ORDERED that the petitioner's Federal Tort Claims Act claims raised in his 6 amended complaint are DISMISSED WITHOUT PREJU DICE. The petitioner may refile these claims in a separate lawsuit.
