MEMORANDUM RULING: For the reasons stated in 16 Report and Recommendation of the Magistrate Judge, after an independent review of the record, a de nova determination of the issues, and consideration of the objections. The Court agrees with the Magi strate Judge's analysis and recommendation at the time of its issuance. Accordingly, IT IS ORDERED 7 Motion to Dismiss for Lack of Subject Matter Jurisdiction is GRANTED IN PART and DENIED IN PART; the claims for injunctive relief are DISMISSE D WITHOUT PREJUDICE for lack of subject matter jurisdiction, and the claims for monetary relief are STAYED pending resolution of the parties' child custody proceedings. IT IS FURTHER ORDERED that Rodock's 13 Request for hearing on her cla ims for injunctive relief and 2 Motion for Writ of Habeas Corpus are DENIED AS MOOT.
