RULING AND ORDER granting in part and denying in part 5 Motion to Dismiss for Failure to State a Claim; granting 11 Motion to Dismiss for Failure to State a Claim; granting 23 Motion to Dismiss. IT IS FURTHER ORDERED that Wingo, a pro se pla intiff, be afforded leave to amend his complaint should he be able to assert facts sufficient to set forth the causes of action hereby dismissed. Wingo is also afforded the opportunity to set forth any applicable supplemental state law claims pertaining to private actors.
