Petitioner has previously filed an application f o r writ of habeas corpus attacking the conviction and sentence challenged herein. The p r e v i o u s application, No. 07-2119, was denied and dismissed with prejudice on February 22, 2 0 0 8 , because it was time-barred by the one-year limitation period imposed by the ADEPA. Before Petitioner can proceed with the instant application he must move in the United S t a t e s Court of Appeals for the Fifth Circuit for an order authorizing the district court to con side r the application. See 28 U.S.C. § 2244(b)(3). A cc or di ng ly; I T IS HEREBY ORDERED that this action is stayed for a period of sixty (60) days.
