ORDER ADOPTING 35 Report and Recommendations; IT IS ORDERED that Defendants' 29 Motion to Dismiss for Failure to State a Claim is granted in part by dismissing Plaintiffs (1) Section 1983 claims against the City of Minden and the three of ficers in their official capacities, (2) Section 1983 claim based on alleged unlawful entry of the premises, and (3) Section 1983 excessive force claim based on the allegation that his handcuffs were applied too tightly.
