ORDER adopting 75 Report and Recommendations; granting in part and denying in part 44 Motion to Dismiss for Failure to State a Claim and Motion for Summary Judgment. The Defendants' Motion [Doc 44] be granted in part, and that Plaintiff&# 039;s claim for monetary damages against all Defendants in their official capacities be dismissed without prejudice in their entirety. FURTHER ORDERED that the named Defendants are terminated because they are not named in the Amended Complaint. FURTHER ORDERED that Defendants' Motion [Doc. 44] be otherwise denied.
