JUDGMENT
For the reasons assigned in the Report and Recommendation of the Magistrate
Judge previously filed herein, and having thoroughly reviewed the record, including the
written objections filed, and concurring with the findings of the Magistrate Judge under the
applicable law;
IT IS ORDERED that Plaintiff’s complaint is DISMISSED pursuant to 28 U.S.C. §
1915(e)(2) because it is frivolous and fails to state a claim on which relief may be granted.
The potential takings clause claim is DISMISSED on the grounds that it is not ripe, so that
claim is DISMISSED WITHOUT PREJUDICE.
