MEMORANDUM RULING re 50 REPORT AND RECOMMENDATIONS re 39 MOTION for Summary Judgment filed by Weston Solutions Inc. The motion is opposed by plaintiff Marine Shale Processors, Inc. 44 . For the following reasons, the recommendations of the magis trate judge are AFFIRMED AND ADOPTED, with the following clarifications noted. For the reasons stated herein, the Motion for Summary Judgment 39 filed by defendant Weston Solutions, Inc., is GRANTED in its entirety. IT IS FURTHER ORDERED that plain tiff's claims against Commerce and Industry Insurance Company and National Union Fire Insurance Company of Pittsburgh, PA are DISMISSED WITH PREJUDICE.
