JUDGMENT Before the Court is petitioner's Motion to Vacate Judgment 16 For the reasons contained in the Report and Recommendation 9 and after an independent review of the entire record, including the petitioner's objection [11; 18], th is Court concludes that the Report and Recommendation is correct and adopts the findings and conclusions as its own. IT IS ORDERED that the Court's November 2, 2012 Judgment 14 is VACATED. IT IS FURTHER ORDERED that plaintiff's civil rights action is DISMISSED WITH PREJUDICE in accordance with Rule 41(b) of the Federal Rules of Civil Procedure.
