MEMORANDUM RULING re 38 MOTION for Summary Judgment filed by Zadok Technologies Inc seeking dismissal of Rowan's claim against Zadok for tort indemnity and/or contribution, is GRANTED, and the foregoing claim is DENIED AND DISMISSED WITH PREJUDICE. Zadok's motion seeking dismissal of Rowan's claim against Zadok for contractual indemnity is DENIED AS MOOT, such claim having been voluntarily dismissed by Rowan. Finally, Zadok's request for relief pertaining to the jury interrogatory form is DENIED at this time, such request being premature at this juncture of the litigation.
