MEMORANDUM RULING For the following reasons, defendant's 21 MOTION for Summary Judgment is GRANTED and plaintiff's 27 MOTION for Summary Judgment is DENIED. As set forth above, the Court finds Dearborn National did not abuse its di scretion, and its decision was supported by substantial evidence. Therefore, because Dearborn National has paid plaintiff the maximum amount of benefits to which he is entitled under the policy, the Court finds summary judgment is warranted in Dearborn National's favor, and plaintiff's complaint is dismissed with prejudice..
