MEMORANDUM RULING: Before the Court in this personal injury suit brought pursuant to the Louisiana Merchant Liability Statute, La. R.S. 9:2800.6, is 19 Motion for Partial Summary Judgment brought by Defendant Cost Plus Inc. Pursuant to its motion, Defendant seeks dismissal of Plaintiffs claims of negligent spoliation of evidence and intentional spoliation of evidence. For the reasons herein, Defendant's 19 Motion for Partial Summary Judgment is hereby GRANTED, and Plaintiff's claims for intentional spoliation of evidence and negligent spoliation of evidence are DISMISSED WITH PREJUDICE.
