Opelousas General Hospital Authority v. Louisiana Health Service & Indemnity Co et al

Filing 36

MEMORANDUM RULING: The Court finds it appropriate to stay this matter pending resolution of transfer issue by MDL panel for the following reasons: a stay will promote judicial efficiency and decrease the possibility of inconsistent pre-trial rulings on similar points of law; plaintiffs will not be prejudiced because they may file objections to transfer before MDL panel; the stay is only in effect until MDL panel issues decision on transfer issue; and in either forum, plaintiff will eventually ha ve motion to remand resolved. For the reasons provided above, IT IS ORDERED defendant's 5 Motion to Stay is GRANTED, and this proceeding is stayed pending decision by JPML on transfer to In re Blue Cross Blue Shield Antitrust Litigation, MDL No. 2406, USDC/NDAL. Signed by Judge Rebecca F Doherty on 7/24/2017. (crt,Putch, A)
