PHELPS'S AND WESTBORO BAPTIST CHURCH'S AMENDED CONSENT MOTION TO CONTINUE SETTLEMENT CONFERENCE, AND TO FOREGO A SETTLEMENT CONFERENCE IF AN AVAILABLE DATE CANNOT BE SCHEDULED Defendants Fred W. Phelps, Sr. ("Phelps") and Westboro Baptist Church, Inc. ("Westboro" or "WBC") (collectively, "Defendants"), respectfully amend their Motion to Continue the Settlement Conference, and to Forego a Settlement Conference if a mutually available date cannot be scheduled, as follows: 1. All parties consent to foregoing a settlement

conference if a mutually available date cannot be scheduled. Plaintiff's counsel Sean Summers gave his consent by e-mail on September 11, 2007. The pro se parties also provided such consent. 2. In the event that Judge Bredar is available September

17, undersigned counsel has asked Plaintiff's counsel Sean Summers if that date still remains unavailable to Plaintiff's side.
