TO ALL COUNSEL OF RECORD AND PRO SE LITIGANTS Subject: Albert Snyder v. Fred W. Phelps, Sr., et al. Civil No. RDB-06-1389 Dear Counsel: Despite diligent effort by and numerous telephone conversations among counsel and the Court, it is determined that a mutually satisfactory date to hold a mediation and settlement conference is unavailable. Therefore, the settlement conference set in for Thursday, September 13, 2007, is VACATED. It is understood that the pretrial and trial schedule set by District Court Judge Richard D. Bennett remains as previously set with a jury trial to commence on October 22, 2007. The referral of this matter to the undersigned is TERMINATED. Further, motions recently filed (Papers No. 129, 131, and 132) are DENIED AS MOOT as they relate solely to the scheduling of a settlement conference.
