Civil No. RDB 06-1389 Dear Counsel and Pro Se Defendants: The parties have inquired of the Court with respect to certain medical records previously sealed. On September 12 and 14, 2007, I entertained the request of the individual pro se Defendants to reconsider my previous rulings on discovery with respect to any sexual activity by the Plaintiff. At that time, I suggested to Plaintiff's counsel that Count One alleging a cause of action for defamation and Count Five alleging a cause of action for conspiracy with respect to defamation, might justify reconsideration of my previous rulings. A hearing is scheduled for this Monday, October 15, 2007, on the Defendants' pending motion for summary judgment. The series of motions in limine which have been filed within the last few days will also be addressed at that hearing. In the event that the Defendants' motion for summary judgment is granted with respect to the defamation count, the matter of the discovery request would be moot. In the event that said motion is denied, I will address the issue of reconsideration of my previous ruling and unsealing certain documents previously sealed. Sincerely, /s/ Richard D.
