PHELPS, SR., et al., Defendants. * * * * * * * * * * * * * * * * * * Civil Action No. RDB-06-1389 ORDER The Plaintiff has filed a Motion in Limine to Preclude Any Evidence or Testimony Concerning Sexual Issues (Paper No. 153), and the pro se Defendants, Rebekah Phelps-Davis and Shirley Phelps-Roper, have filed a response to said motion (Paper No 169). This Court granted the Defendants' motions for summary judgment on Count I of the Amended Complaint alleging defamation. Accordingly, the Defendants' proffered basis for the admission of any evidence concerning sexual activities as it relates to the defamation claim is now moot. With respect to the suggestion that a lifestyle may be at odds with the religious viewpoints of the Defendants, the Defendants are certainly free to express their viewpoints. However, those viewpoints do not form a basis for the introduction of the evidence of sexual activity of the Plaintiff. Accordingly, the Plaintiff's Motion in Limine to Preclude Any Evidence or Testimony Concerning Sexual Issues (Paper No. 153) is GRANTED. /s/ Richard D.
