PHELPS, SR., et al., Defendants. * * * * * * * * * * * * * * * * * * Civil Action No. RDB-06-1389 ORDER Four motions filed by the Defendants in this case are incorrectly listed on the Court Docket as still pending. Two of these were improperly filed as motions. The Motion to Amend/Correct filed by Fred W. Phelps, Sr., and Westboro Baptist Church, Inc. (Paper No. 89) was merely an update to a previously filed discovery motion. The Motion to Seal Reply in Opposition to Motion to Reconsider filed by Fred W. Phelps, Sr., and Westboro Baptist Church, Inc. (Paper No. 118) was not in fact a motion to seal but rather a reply brief. The other two motions listed as pending are now MOOT but were implicitly GRANTED at the time they were filed. The Motion for Extension of Time for Rule 26(a)(2) Submissions filed by Rebekah A. Phelps-Davis and Shirley L. Phelps-Roper (Paper No. 94) was intended to preserve the pro se Defendants' right to file additional 26(a)(2) submissions before July 16, 2007, and the Defendants were not prevented from doing so. Similarly, the Interim Sealing Motion filed by Albert Snyder (Paper No. 109) was intended to extend the Court's pre-existing sealing order regarding information obtained during discovery, which remained in place until trial. Dockets.Justia.com Accordingly, for the foregoing reasons, it is this 10th day of December 2007, HEREBY ORDERED that the Docket Entries shall reflect that: 1. The Motion to Amend/Correct filed by Fred W. Phelps, Sr., and Westboro Baptist Church, Inc. (Paper No. 89) was not in fact a motion and is now MOOT; 2. The Motion to Seal Reply in Opposition to Motion to Reconsider filed by Fred W. Phelps, Sr., and Westboro Baptist Church, Inc. (Paper No. 118) was not in fact a motion and is now MOOT; 3. The Motion for Extension of Time for Rule 26(a)(2) Submissions filed by Rebekah A. Phelps-Davis and Shirley L. Phelps-Roper (Paper No. 94) was GRANTED and is now MOOT; 4. The Interim Sealing Motion filed by Albert Snyder (Paper No. 109) was GRANTED and is now MOOT; and 5.
