MEMO TO COUNSEL RE:
COSTAR REALTY INFORMATION, INC., et al. v. CENTERS & MALLS, LLC, et al. (AW-07-1182)
Dear Counsel: On May 8, 2007, Plaintiff filed a Complaint in this case and simultaneously filed a Motion for a Temporary Restraining Order. On the same day, the Court held a telephonic conference with counsel for both parties. In accordance with the Court's comments at the telephonic conference, the Court will reserve ruling on the Motion at this time. Instead, Defendants will have until May 23, 2007 to brief their contention that Plaintiffs lack ability to maintain this suit and the issue of personal jurisdiction. Plaintiffs will have ten days thereafter to respond. Meanwhile, the Court will permit Plaintiffs to conduct limited discovery with respect to the jurisdictional question. The Court will set the matter down for a hearing on June 8, 2007 at 9:30 AM. Despite the informal nature of this ruling, it shall constitute an Order of Court, and the Clerk is directed to docket it accordingly.
