Grim No. 18-cr-00155-PJM-l TRAVELL XAVIER SHELTON Petitioner-Defendant. MEMORANDUM OPINION Petitioner Travell Xavier Shelton has filed a Motion to Vacate his Sentence under 28 U.S.C. § 2255. EOF No. 42. No hearing is necessary. See e.g.. United States v. White, 366 F.3d 291, 302(4th Cir. 2004). For the reasons that follow,the Court DENIES the Motion. I. Background On September 24,2019, Shelton pled guilty to Count 1 of an Indictment charging him to be a Felon in Possession of a Firearm and Ammunition, 18 U.S.C. § 922(g)(1). ECF No. 22. He was sentenced on December 12,2018,to 51 months imprisonment,3 years supervised release, plus a $100 special assessment. ECF No. 37. Shelton had previously been convicted of offenses punishable by more than one year of imprisonment, which precluded him from possessing a firearm under 18 U.S.C. § 922(g). ECF No. 30 at 5. His prior convictions included, but were not limited to, Possession with Intent to Distribute Controlled Substance, in the Circuit Court for Prince George's County (2016, Case No. CT160101X)and Firearm Possession After Felony, in the Circuit Court for Prince George's County (2016, Case No. CT170058X). ECF No. 30 at 5. -1- .
