ORDER FOR ISSUANCE OF FIRST CY PRES PAYMENT TO DANA FARBER CANCER INSTITUTE November 16, 2010 STEARNS, D.J. On August 6, 2010, this court awarded the surplus funds from the LupronŽ Class Settlement Pool to Dana-Farber/Harvard Cancer Center (DF/HCC) and the Prostate Cancer Foundation (PCF) to be distributed according to the terms of the proposal submitted to the court on May 20, 2010 (attached to the Order as Appendix A) and the subsequent orders of the court. DF/HCC has informed the court that PCF anticipates that it will release the first series of its Requests for Applications (RFAs) by the end of December 2010 or before, and that DF/HCC will release its first RFAs by the end of February 2011, or before. To facilitate the grant awards process, the court directs the Court Registry Investment System to issue a check in the amount of $4,000,000.00 to Dana Farber Cancer Institute d/b/a Dana-Farber/Harvard Cancer Center to be deposited into a dedicated account and used for the purposes identified in the court's August 6, 2010 Order. Future installments will be paid over according to the schedule established by the court after a review of the required accounting of accrued expenditures. SO ORDERED. /s/ Hon. Richard G.
