Dunner, LLP, counsel for Plaintiffs ConnectU, Inc., Cameron Winklevoss, Tyler Winklevoss, and Divya Narendra. I make this Declaration in support of Plaintiffs' Motion For Sanction Of Non-Dismissal, Or In The Alternative To Vacate Final Judgment Pursuant to F.R.C.P. 60. I am an active member in good standing of the Bar of the District of Columbia and I am admitted to appear pro hac vice before this Court. Zuckerberg's counsel told ConnectU's counsel during the Summer 2005

discovery conferences that the 371-01 Device was lost. 4. During a series of four discovery conferences in Summer 2005, ConnectU tried to

resolve Defendants' objections, to no avail.
