hereby ACCEPTS AND ADOPTS the Magistrate Judge's Report and Recommendation. It is
further ordered that Plaintiff's motion for summary judgment is GRANTED, Defendant's motion
for summary judgment is DENIED, and the case is hereby REMANDED for further proceedings.
