AMENDED1 ORDER DENYING PLAINTIFF’S MOTION TO STRIKE ANSWER
Pending before the court is a Motion to Strike, in part, the Defendants’ Answer, filed
by Plaintiff on October 14, 2014. (Dkt. # 12.) However, that same day Plaintiff amended
his complaint as of right. See Fed. R. Civ. P. 15 (a)(1)(B). This rendered the original
Complaint—and by extension, the Answer—nullities.2 Drake v. City of Detroit, 266 F.
App’x 444, 448 (6th Cir. 2008). Accordingly,
IT IS ORDERED that Plaintiff’s Motion to Strike, in part, the Defendants’ Answer
(Dkt. # 12) is DENIED AS MOOT.
