The matter was referred to Magistrate Judge Patricia T. Morris for determination of all nondispositive motions under 28 U.S.C. § 636(b)(1)(A) and issuance of a report and
recommendation pursuant to 28 U.S.C. § 636(b)(1)(B) and (C). Thereafter, the parties filed
cross-motions for summary judgment.
