ACCORDINGLY, IT IS ORDERED that the Report and Recommendation of the Magistrate Judge (ECF No. 72) is approved and adopted as the opinion of the Court. IT IS FURTHER ORDERED that Plaintiff’s claims for damages against Defendant in his official capacity are DISMISSED WITH PREJUDICE. IT IS FURTHER ORDERED that Plaintiff’s claim stemming from his confinement in temporary segregation is DISMISSED WITH PREJUDICE. IT IS FURTHER ORDERED that Defendant’s Motion for Summary Judgment (ECF No. 32) is GRANTED, and Plaintiff’s remaining claims are DISMISSED WITHOUT PREJUDICE. IT IS FURTHER ORDERED that this matter is TERMINATED. The Court discerns no good-faith basis for appeal of this matter. See McGore v.
