ORDER MODIFYING SECOND AMENDED PRETRIAL SCHEDULING ORDER Based on the parties' Joint Motion for Modification of the Second Amended Pretrial Scheduling Order (Doc. No. 164), seeking an extension of the Pretrial Scheduling Order (Doc. No. 71), as amended by the Amended Pretrial Scheduling Order (Doc. No. 104), and the Second Amended Pretrial Scheduling Order (Doc. No. 111) in order to complete foreign discovery and other depositions and to allow time to complete expert discovery after the September 23, 2010 Claim Construction hearing. Having reviewed the joint motion and the records and files herein, and finding that good cause has been shown pursuant to Rule 16 of the Federal Rules of Civil Procedure and Local Rule 16.3, IT IS HEREBY ORDERED that the motion is GRANTED and the Second Amended Pretrial Scheduling Order [Docket No. 111] is AMENDED as follows: 1. Fact discovery shall be commenced in time to be completed on or before October 29, 2010. Dockets.Justia.com 2. On or before January 5, 2011, the parties shall identify to the opposing party the experts who will provide a report that deals with the issues on which that party has the burden of persuasion. On or before February 7, 2011, the parties shall exchange initial expert reports, which reports shall be in accordance with Fed. R. Civ. P. 26(a)(2)(B) ("Initial Expert Reports"). The Initial Expert Reports from each party shall deal with the issues on which that party has the burden of persuasion. On or before March 11, 2011, Rebuttal Expert Reports shall be exchanged. Rebuttal Expert Reports shall also be in accordance with Fed. R. Civ. P. 26(a)(2)(B). All expert discovery shall be completed by April 29, 2011. All other non-dispositive motions and supporting documents, including those which relate to discovery, shall be served and filed on or before November 15, 2010. All non-dispositive motions relating to the expert discovery shall be served and filed on or before May 13, 2011. 3. 4. 5. 6. 7.
