Plaintiff shall refile a new lawsuit in this Court alleging diversity jurisdiction under 28 U.S.C. § 1332. 3. Upon the refilling of the new lawsuit, the docket entries from Civil No. 05-2305 (DWF/AJB) shall be transferred into the new lawsuit's docket.
