The Court construing Plaintiff Daywitt’s Motion to Dismiss as a Notice of
Voluntary Dismissal, and, accordingly, that the present action, as alleged by Plaintiff
Daywitt, is DISMISSED WITHOUT PREJUDICE. Plaintiff Geiger’s claims are
unaffected by the present order.
