The above matter comes before the Court upon the Report and Recommendation of
United States Magistrate Judge Katherine Menendez dated December 19, 2016. No objections
have been filed to that Report and Recommendation in the time period permitted. Based on the
Report and Recommendation of the Magistrate Judge, on all of the files, records, and
proceedings herein, the Court now makes and enters the following Order.
IT IS HEREBY ORDERED that:
1. The Defendants’ motions to dismiss for lack of prosecution and failure to comply with
court orders [ECF No. 36] is GRANTED.
2. The Defendants’ motion for summary judgment [ECF No. 45] is DENIED AS MOOT.
3. The Defendants’ motion for continuance of the dispositive motion deadline [ECF No.
41] is DENIED AS MOOT.
4. This action is DISMISSED WITH PREJUDICE.
