IT IS, THEREFORE, ORDERED that the Report and Recommendation of United States Magistrate Judge Michael T. Parker be, and the same is hereby, adopted as the finding of this Court, and that Respondent Sam Winchester’s Motion [5] to Dismiss is GRANTED and Petitioner Lee Alexander Brooks’ Petition [1] for a Writ of Habeas Corpus under 28 U.S.C. § 2254 is DISMISSED with prejudice. A separate judgment will be entered herein in accordance with this Order as required by Rule 58 of the Federal Rules of Civil Procedure.
