IT IS HEREBY ORDERED that the defendants' Motion to Dismiss, filed J anuary 18, 2011 (#17) is GRANTED. IT IS FURTHER ORDERED that plaintiff's complaint if DISMISSED without prejudice. IT IS FURTHER ORDERED that plaintiff's second Motion to Appoint Counsel, filed February 18, 2011 (#19) is DENIED as moot.
