MEMORANDUM OPINION: IT IS HEREBY ORDERED that NYLIC's Motion for Summary Judgment on All Counts of the Complaint is GRANTED, as to Counts I-III and V, of the Complaint; Docs. 3 , 37 IT IS FURTHER ORDERED that the NYLIC's Motion for Summa ry Judgment on Counts I, III, and V of Counterclaims and Feldmann's Motion for Summary Judgment on All Counts of Counterclaim are DENIED; Docs. 39 , 43 . IT IS FURTHER ORDERED that at the end of proceedings in this matter a judgment shall issue which reflects that NYLIC's Motion for Summary Judgment on All Counts of the Complaint has been granted, in its entirety, in NYLIC's favor.
