counts with prejudice (Doc. 86), and good cause appearing,
IT IS HEREBY ORDERED that Counts II and III of Kinkaid Civil
Construction, LLC’s Counterclaim are dismissed with prejudice, with each party to
bear its own attorneys’ fees and costs.
