ORDER ADOPTING FINDINGS AND RECOMMENDATIONS. IT IS ORDERED that the proposed 31 FINDINGS AND RECOMMENDATIONS entered by the United States Magistrate Judge are ADOPTED IN FULL. IT IS FURTHER ORDERED that defendant's 16 MOTION to Dismiss Pursuant to Rule 12(b)(1) and 12(b)(6) is GRANTED as to Counts 3 through 6 and DENIED as to Counts 1 and 2 of Plaintiff's Second Amended Complaint. Counts 3 through 6 of Plaintiff's Second Amended Complaint are DISMISSED without prejudice. Plaintiff is granted leave to amend his complaint until September 30, 2019. Signed by Judge Susan P.
