FINDINGS OF FACT AND CONCLUSIONS OF LAW, MEMORANDUM AND ORDER- IT IS ORDERED that: The Clerk of Court shall upload Courts Exhibit 1 to CM/ECF as a restricted document. Except as noted within this order, the Nebraska laws that were enacted by L97 ( 2009) and LB 285 (2009) are constitutional. The claims of the plaintiffs who are not required to register as sex offenders are dismissed without prejudice as moot. The claims of the plaintiffs who are shown on Courts Exhibit 1 to have withdrawn fro m participation in this lawsuit are dismissed without prejudice. Final judgment will be withheld pending resolution of the attorney fee issue. Counsel for the plaintiffs shall have until November 1, 2012, to submit anapplication, evidence, evidence index, and brief regarding attorney fees. Counsel for the defendants shall have until November 16, 2012, to respond with evidence, evidence index, and brief. Both sides shall give due attention to the local rules of practice regarding attorney fee applications. Counsel are also encouraged to settle the attorney fee issue, if they can, recognizing that the plaintiffs have been partially, but not wholly, successful.Member Cases: 8:09-cv-00456-RGK-CRZ, 4:09-cv-03266-RGK-CRZ, 4:10-cv-03005-RGK-CRZOrdered by Senior Judge Richard G.
