FEDERAL DEPOSIT INSURANCE CORPORATION, as Receiver for TierOne Bank, Defendant. ) ) ) ) ) ) ) ) ) ) ) 4:10CV3182 MEMORANDUM AND ORDER A telephonic conference was held today to discuss: 1) whether the motion to stay filed in state court and removed to this forum has been resolved; 2) whether this case must or should be stayed; and 3) whether a progression order should be entered at this time. The parties agree the motion to stay filed in state court was resolved in that forum prior to removal, and is not currently pending in this forum. As to whether the case should be stayed or progressed at this time, a threshold factual issue was identified and discussed during the conference call; specifically, whether the plaintiff timely filed a notice of claim. The plaintiff states that despite the FDIC's failure to properly notify the plaintiff of her responsibility and deadline for filing a notice of claim, the plaintiff did timely file her notice, but it was erroneously denied by the FDIC as untimely. The parties need additional time to investigate the merits of the notice of claim issue. The plaintiff may also be requesting agency review of her FDIC claim denial which, in turn, may (or may not) affect whether a progression schedule can or should be entered at this time; the defendant may be requesting a stay of these court proceedings; or the parties may agree to progress this case. Dockets.Justia.com After conferring with the parties, the court concludes the foregoing described preliminary matters should be addressed at the outset of this case and in succession, beginning with the notice of claim issue. Accordingly, IT IS ORDERED: 1) The Motion to Stay filed in the state forum and removed to this court, (filing no. 1-4), was ruled on in the state court and is not awaiting ruling in this forum. The parties shall confer, and to the extent possible, shall file a joint statement outlining the parties' agreement or their respective positions regarding the following issues: a. Whether the plaintiff submitted a timely and proper notice of claim to the FDIC, If a timely notice of claim was filed by the plaintiff, and denied by the F D IC , ­will the plaintiff pursue agency review of the FDIC's denial of her claim and if so, does that affect: 1) whether this case is currently ripe for adjudication; 2) should be stayed; or 3) should be progressed at this time? ­will the FDIC move to stay this litigation and when, or upon what event, is that stay to be lifted? ­should a progression schedule be entered at this time and, if not, when do the parties anticipate this case will be ready for progression to trial? c. Whether an additional conference call with the court is needed before the court enters an order requiring the parties to prepare and file a Rule 26(f) Report of Parties' Planning Conference, a copy of which is attached. -2- 2) b. 3) The joint statement set forth in the paragraph (2) shall be filed on or before November 1, 2010. A telephonic conference will be held before the undersigned magistrate judge on November 3, 2010 at 11:00 a.m. (C.D.T.) to discuss any remaining initial scheduling, stay, or case progression issues.
