ORDER TO SHOW CAUSE - ORDERED that respondent, George E. Fox, appear before the District Court of the United States for the District of Nebraska in that branch thereof presided over by the Honorable Magistrate Judge Cheryl R. Zwart, the undersigned, in the Robert V. Denney Courthouse, 100 Centennial Mall North, Lincoln, Nebraska 68508 at 10:00 A.M. on the 5th day of May, 2010, at Courtroom 2, to show cause why respondent should not be compelled to comply with the Internal Revenue Service summons served on respondent on October 8, 2009. A copy of this Order, together with the Petition and Exhibits thereto, be served on George E. Fox, by an official of the Internal Revenue Service who is hereby specially appointed for that purpose, within thirty (30) days of the date of this Order. Ordered by Magistrate Judge Cheryl R. Zwart. It is further O R D E R E D that a copy of this Order, together with the Petition and Exhibits th e re to , be served on George E. Fox, by an official of the Internal Revenue Service who is h e re b y specially appointed for that purpose, within thirty (30) days of the date of this O rd e r. It is further O R D E R E D within 5 days of service of copies of this Order, the Petition and E x h ib its thereto, respondent shall file and serve a written response to the petition. That if re sp o n d e n t has any defenses to present or motions to make in opposition to the petition, s u c h defenses or motions, if any, shall be made in writing and filed with the Court, and c o p ie s served on the United States Attorney at least five (5) business days prior to the d a te of the show cause hearing. Only those issues raised by motion or brought into c o n tro v e rs y by the responsive pleading shall be considered by the Court and any u n c o n te ste d allegations in the petition shall be deemed admitted; and further O R D E R E D that if respondent has no objection to compliance with the summons, r e sp o n d e n t may, at least three (3) business days prior to the date of the show cause h e a rin g , notify the clerk of this Court, in writing, with copies to the United States A tto rn e y, of the fact that no response or appearance as ordered herein will be required.
