Banks, appear before the District Court of th e United States for the District of Nebraska in that branch thereof presided over by the H o n o ra b le Magistrate Judge Cheryl R. Zwart, the undersigned, in the Robert V. Denney C o u rth o u s e , 100 Centennial Mall North, Lincoln, Nebraska 68508 at 10:30 A.M. on the 5 th day of May, 2010, at Courtroom 2, to show cause why respondent should not be c o m p e lle d to comply with the two (2) Internal Revenue Service summonses served on re sp o n d e n t on November 10, 2009. It is further O R D E R E D that a copy of this Order, together with the petitions and Exhibits th e re to , be served on Adonica Banks, by an official of the Internal Revenue Service w ith in thirty (30) days of the date of this Order. It is further O R D E R E D within 5 days of service of copies of this Order, the petitions and E x h ib its thereto, respondent shall file and serve a written response to the petitions. That if respondent has any defenses to present or motions to make in opposition to the p e titio n s , such defenses or motions, if any, shall be made in writing and filed with the C o u rt, and copies served on the United States Attorney at least five (5) business days p rio r to the date of the show cause hearing. Only those issues raised by motion or b ro u g h t into controversy by the responsive pleading shall be considered by the Court and a n y uncontested allegations in the petitions shall be deemed admitted; and further O R D E R E D that if respondent has no objection to compliance with the summonses, r e sp o n d e n t may, at least three (3) business days prior to the date of the show cause h e a rin g , notify the clerk of this Court, in writing, with copies to the United States A tto rn e y, of the fact that no response or appearance as ordered herein will be required.
