SCHEDULING ORDER - IT IS ORDERED: The Joint Motion to Set Briefing Schedule and Hearing on Motion for Preliminary Injunction (filing 5 ) is granted. This matter is before the Court on the parties' Joint Motion to Set
Briefing Schedule and Hearing on Motion for Preliminary Injunction (filing
5). The motion will be granted.
IT IS ORDERED:
1.

The Joint Motion to Set Briefing Schedule and Hearing on
Motion for Preliminary Injunction (filing 5) is granted.

2.

Defendant BNSF will file its motion for preliminary
injunction on or before September 4, 2013.

3.

Plaintiff Brotherhood of Maintenance of Way Employees
Division may file its response to BNSF's motion on or
before September 13, 2013.

4.

BNSF may file a reply in support of its motion on or before
September 18, 2013.

5.

A hearing will be scheduled for September 25, 2013, to
commence at 9:30 a.m. in Courtroom 1, Robert V. Denney
Federal Building, 100 Centennial Mall North, Lincoln,
Nebraska.

6.

A brief procedural prehearing teleconference will be
