On August 28, 2020, the court ordered Plaintiff to file an amended
complaint within 30 days or face dismissal of this action. To date, Plaintiff has n ot
filed an amended complaint. Rather, Plaintiff sent correspondence to t he court on
September 16, 2020, indicating that he would not be filing an amended com plaint
pro se. (Filing 19.)
IT IS THEREFORE ORDERED that: This matter is dismissed without
prejudice because Plaintiff failed to prosecute it diligently an d failed t o com ply
