IT IS HEREBY STIPULATED AND AGREED, by and between the Plaintiff,

above named, by and through her undersigned counsel, KIRK T. KENNEDY, ESQ., and

Defendants, above named, by and through their undersigned counsel, JILL C. DAVIS,
21

Senior Deputy Attorney General, that the deadline to file the pre-trial order, which is
22

currently Friday, December 11, 2009, shall be continued for not less than 40 days, as the
23

parties are engaging in active settlement discussions which will resolve the case within
24

the next 30 days and allow time for the parties to exchange settlement related
25

documentation.
