NASSIRI, D.C., et al., 12 Defendants. 13 14 ORDER 15 Presently before the court is defendants Albert Noorda and Maryland Medical Center, LLC’s 16 motion for leave to file excess pages. (Doc. #402). Plaintiffs Allstate Insurance Company, et. al. 17 filed an opposition and a counter-motion to strike defendants’ motion for summary judgment. (Doc. 18 #409). Defendants did not file a reply. 19 On the same day defendants filed the instant motion, they filed a 77-page motion for 20 summary judgment. (Doc. #403). Defendants’ summary judgment motion more than doubles the 21 30 pages allowed pursuant to Local Rule 7-4. Because defendants filed both the motion for leave 22 to file excess pages and the motion for summary judgment on the same day, this court did not have 23 an opportunity to review defendants’ motion for leave to file excess pages before defendants filed 24 the motion for summary judgment. 25 Accordingly, 26 IT IS HEREBY ORDERED, ADJUDGED, AND DECREED that defendants Albert Noorda 27 and Maryland Medical Center, LLC’s motion for leave to file excess pages (doc. #402) be, and the 28 James C. Mahan U.S. District Judge 1 same hereby is, DENIED. 2 IT IS FURTHER ORDERED, ADJUDGED, AND DECREED that plaintiffs Allstate 3 Insurance Company, et. al.’s counter-motion to strike defendants’ summary judgment motion (doc. 4 #409) be, and the same hereby is, GRANTED.
