Marketing, Inc. (collectively “Defendants”), file this Unopposed Motion to Appear telephonically at

the April 12, 2013, Final Fairness Hearing for the reasons as set forth below:

The original hearing date was set for April 19, 2013.

This Honorable Court later changed the hearing date to April 12, 2013.

On April 3, 2013, this Honorable Court changed the hearing date to May 7, 2013.

Defendants had already made travel arragements for May 7, 2013; however, on April

5, 2013, this Honorable Court moved the hearing date back to April 12, 2013.

Because the hearing changed on such short notice, airplane tickets1 have increased

substantially and Defendants have undertaken other commitments.

In light of the new deadline, Defendants request to appear telephonically.

Plaintiffs’ counsel will be physically present and do not object to Defendants’
