1 2 3 UNITED STATES DISTRICT COURT 4 DISTRICT OF NEVADA 5 6 7 _____________________________________ DONNA CORBELLO, 8 Plaintiff, 9 10 vs. THOMAS GAETANO DEVITO et al., 11 Defendants. ) ) ) ) ) ) ) ) ) ) ) ) 2:08-cv-00867-RCJ-PAL ORDER 12 Plaintiff Donna Corbello is the widow and heir of Rex Woodard, who assisted Defendant 13 14 Thomas Gaetano “Tommy” DeVito in writing his unpublished autobiography (the “Work”). 15 Plaintiff alleges that DeVito and others wrongfully appropriated the Work to develop the 16 screenplay for Jersey Boys, a hit musical based on the band The Four Seasons that has played in 17 the United States, Canada, England, and Australia. The Court granted summary judgment to 18 certain Defendants and certified the order for immediate appeal. The Court of Appeals reversed 19 and remanded for further proceedings. The Court then determined on summary judgment that 20 the Work would be entitled to “thin” copyright protection at trial. Plaintiff has asked the Court 21 to reconsider.
