Presently before the Court is Plaintiff’s Motion for Reconsideration (#44). On September 28,

17

2011, the Court granted (#43) Defendants’ motion for summary judgment on his exercise claim.

18

Plaintiff now seeks reconsideration of that order asserting that the Court has not considered “the

19

nature of the case[.]” However, the Court has considered Plaintiff’s claim that he has not received

20

adequate exercise in his four years in segregation and has rejected it.

21

Accordingly, Plaintiff’s Motion for Reconsideration (#44) is DENIED.
