Mahan, United S ta te s District Judge, presiding, and the issues having been duly heard and a decision having b e e n duly rendered, granting Plaintiffs' Motion for Summary Judgment on the following c la im s ; and the court finding that there is no just reason for delaying the review of a ju d g m e n t on fewer than all of the claims: T h e Plaintiffs' First Claim for Relief seeking a declaratory judgment pursuant to 28 U .S .C . § 2201, et seq. that Nye County Code § 9.20.090.A, which states, " T h e application shall be made upon such forms as the Board may p re s c rib e and shall contain at least the following information and minimal re q u ire m e n ts for a license: T C R HOLDINGS, LLC, A Nevada L im ite d Liability Company and BRUCE K A H N , an individual, P la in tiffs , C a s e Number 2:09-CV-00433-JCM-GWF H o n . Evidence that applicant, or one applicant as defined in this Chapter, is a bona fide resident of the State and has been so for six (6) months . . . ." V io la te s the dormant Commerce Clause of the United States Constitution and the Plaintiffs' s e c o n d claim for relief seeking an injunction against enforcement of that provision. The two c la im s enumerated above are severed from the remainder of the case pursuant to Rule 54(b) o f the Federal Rules of Civil Procedure and on those claims it is ORDERED and A D J U D G E D in favor of Plaintiffs TCR Holdings, LLC and Bruce Kahn and against D e fe n d a n t Nye County, Nevada as follows: P u rs u a n t to 28 U.S.C. § 2201, et seq. the court DECLARES that Nye County Code § 9.20.090.A, which states, " T h e application shall be made upon such forms as the Board may p re s c rib e and shall contain at least the following information and minimal re q u ire m e n ts for a license: " A .
