Specifically, the Court finds that the particular Rule 23 class certification sought by Plaintiffs in this case is incompatible with the already approved FLSA collective action. Moreover, the individualized liability and damages claims of each putative class member predominate and render Rule 23 class action treatment Dockets.Justia.com 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 inappropriate.
